Welcome to Bestie Bite! Access to and use of our platform ("Platform") and related services ("Service") are governed by these Terms and Conditions ("T&C").
By accessing or using the Platform, the user agrees to comply with these T&C. If the user does not fully accept them, they may not access or use the Service.
BESTIE BITE srl, with registered office at Via Franco Sacchetti 127 - 00137 Rome, is the sole owner of the Platform and related functions through which the Service described below is provided and managed, as well as all related rights pertaining to and connected with the exploitation of the Platform itself.
By registering for or using the Service, users confirm that they accept these Terms and Conditions and agree to comply with them. The term "User" also refers to individuals who publish and share their content (also referred to as "Creators"), following registration and creation of a profile through the Platform. Access to and use of the Service are also subject to the Privacy Policy and the Cookie Policy, the terms of which are available on the Platform.
Use of the Service is permitted only to individuals who are of legal age under Italian law (over 18 years old). In the case of minors, any use of the Service is granted subject to the authorisation and supervision of parents or legal guardians, who shall be responsible for the minor's conduct towards BESTIE BITE srl and any third parties involved. These Terms and Conditions apply exclusively to the services of BESTIE BITE srl. In the case of intermediation of services offered by third-party providers, the Terms and Conditions of each provider shall apply in addition to and separately from these Terms and Conditions, with respect to which BESTIE BITE srl remains uninvolved and bears no responsibility.
The objective of BESTIE BITE srl is to enhance the experiential dimension of quality dining through the marketplace model. To achieve this objective, BESTIE BITE srl has developed personalised opportunities for the creation, sharing and communication of travel and food & wine experiences within its Community. In order to foster the growth of the Community and thereby make the experiences increasingly inclusive, while at the same time ensuring the security of the Platform, BESTIE BITE srl develops and uses advanced technologies that enable the personalisation, protection and improvement of the Service. Content is provided exclusively in video format and is published and shared by the platform owners following approval by the Creators, through a dedicated agreement with BESTIE BITE srl, to which reference is made for the specific terms governing the relationship. The publication of content on the Platform grants BESTIE BITE srl the broadest possible right of use including, by way of example but not limited to, the right to repost content on its social media profiles, use it for promotional, advertising, editorial activities, or otherwise for the dissemination of the Platform and the enhancement of its services. Partner restaurants and/or parties involved in the creation of experiences promoted through the Platform are also authorised, unless otherwise agreed with BESTIE BITE srl and/or the Creators, to reuse published content for purposes strictly connected to and functional for the promotion of their business in relation to the services offered through BESTIE BITE srl. Such use may include, by way of example but not limited to, sharing content on websites, social media, booking platforms and other commercial channels, provided it is consistent with the image and values of the Platform. Users can access video content to discover culinary experiences and restaurants recommended by the Community. The Platform also offers the following features: — Collections: users can create curated lists of favourite restaurants and share them with other Community members. — Taste Match: an algorithm that calculates taste compatibility between users based on their review history, sending a notification when a significant match is found. — Follow system: users can follow each other and receive a personalised feed with reviews from followed users, as well as a weekly digest via push notification. — "Helpful" vote: users can vote reviews as helpful, contributing to improving the visibility of quality content. — Background visit detection: with explicit consent, the app monitors location in the background to detect restaurant visits and suggest leaving a review. For more details, please refer to the Privacy Policy. — GPS video verification: GPS metadata from videos is extracted and compared with the restaurant's location to verify the authenticity of the review.
By publishing content on the Platform, the User (including Creators) grants BESTIE BITE srl a perpetual, irrevocable, non-exclusive, transferable and sublicensable licence, valid worldwide, for the use of said video content, free of charge, for promotional, advertising, editorial and commercial purposes, including but not limited to dissemination through official social media channels, marketing campaigns, digital and traditional media advertising, as well as for any other purpose functional to the promotion of the Services and the Platform. The User acknowledges and accepts that published content may also be reused by partner restaurants and/or other third parties, provided it is for purposes consistent with the promotion of their business within the BESTIE BITE srl ecosystem.
Users who receive compensation (monetary or in points) for the publication of content irrevocably assign to BESTIE BITE srl the commercial exploitation rights of the uploaded videos, without prejudice to the right to delete such content from their personal area/profile at any time. However, the videos will remain visible and accessible on the associated restaurant page and may be reused in accordance with the promotional purposes of the Platform, as well as by partner parties involved in the promotion of experiences. This applies in particular to content that has given rise to a reward or compensation and which, therefore, is to be considered acquired by BESTIE BITE srl under the terms established herein.
Bestie Bite has developed a rewarding system that assigns points to Creators based on the value of the video content published. The score is determined by an algorithm that takes into account various parameters, such as video quality and duration, participation in "missions", and use of the referral system. The value attributed to points may vary over time at the sole and full discretion of Bestie Bite. The table with details on the value of videos and missions is available both in the app in the dedicated section and at the following link: Bestie Bite Reviewers. Users can also earn points by participating in specific missions, such as creating content at certain restaurants, where videos may be worth more points, or by inviting friends to the platform through the referral system. The rewarding system also includes the following mechanics: — Crew and Weekly Ranking: users participate in a competitive weekly ranking organised in different tiers and levels. At the end of each week, users may be promoted or demoted based on their activity. — Mystery Box: top-ranked users in the weekly ranking may receive prizes including bonus points and temporary multipliers (2x, 3x, etc.) applied to subsequently earned points. — Daily Streak: a counter tracks consecutive days of user activity on the Platform. Bonus points are awarded upon reaching certain milestones. The longest streak record is also tracked. — Badges and Achievements: a system of unlockable milestones upon completion of specific activities. Badges are visible on the user's profile and their attainment is notified via push notification. — Birthday Gift: annual bonus points awarded on the user's birthday. — Point Multipliers: temporary boosts to point earnings, obtained through mystery boxes, with a limited number of uses.
The referral system awards points for each new user who signs up through an invitation. However:
Invitations are valid only for individuals other than the user making the invitation.
Email addresses associated with the same IP, temporary domains, or suspicious accounts will not be accepted.
The monthly limit for sharing the referral code is 3 verified invitations.
Each invitation is subject to security checks and verification, and redemption times may take up to 60 business days. Bestie Bite reserves the right not to award points in case of fraudulent use of the system.
Payment for the Service may be made exclusively through a Paypal account, following the methods described below. The Buyer may access their Paypal account, if they already have one, or create a new Paypal account following the indicated procedures. The payment system may charge fees to Users for using the service, and such fees are borne by the Users who acknowledge that they are solely responsible for their payment. The Company is not responsible for such fees. Users are solely responsible for the security of their credentials and the payment method associated with their Paypal account. If requested by the Company, the User is obligated to update their payment method. The Company reserves the right not to disburse points converted into money on Paypal in case of any fraudulent activity detected.
legitimate payments will be processed within 7 business days from the date of the request. However, in case of verification of the legitimacy of the payment request, processing times may extend up to 60 business days or more. Users are informed that the Company may request additional information or documents to complete the verification process.
Users are required to verify the accuracy of the data entered during the purchase procedure and to report any inaccuracies to the Company. The Company reserves the right to refuse or delay payment in case of incorrect or incomplete data.
the Company reserves the right to make changes to these Terms and Conditions, and Users will be informed of such changes through the platform or appropriate means of communication.
In order to protect the User from fraudulent practices, the Services and payments within the App are subject to regular checks. As part of this procedure, the Company may suspend the processing of an order and contact the User to obtain the supporting documents necessary to unblock the order: e.g. proof of address, identity or bank details. Such documents must correspond to the data of the Paypal account holder used. These documents may be requested via email. Failure to provide them may result in the cancellation of the order.
Users agree to use the Platform in accordance with the uses identified in these Terms and Conditions. Users are fully and exclusively responsible for their use of the Service and are, therefore, the sole guarantors and responsible for the correctness, completeness and lawfulness of their conduct. Users are not permitted, by way of example and not limited to:
provide inaccurate information, assume identities other than their own, or create accounts for other individuals; act in an illegal, deceptive, or fraudulent manner or for an illegitimate or unauthorised purpose
collect information through automated systems, or request, collect, or use login credentials belonging to other users
create unauthorised copies, modify, adapt, translate, reverse engineer, disassemble, decompile, or create derivative works
licence, distribute, transfer, or sell, even partially, the Service or any derivative work thereof
commercialise the Service or use the Platform to advertise or facilitate commercial advertising without the express consent of BESTIE BITE srl (including, for example, through solicitations, promotional materials, junk mail, spam, chain letters, pyramid schemes)
fraudulently use their referral code through spamming within and outside the platform in order to increase their in-app score
interfere with the proper functioning of the Platform or any network connected to the Service
publish: sexually explicit material; violent or discriminatory content based on race, gender, religion, nationality, disability, sexual orientation, or age; material that is defamatory, obscene, offensive, pornographic, inciting, or that incites, provokes, or encourages hatred, harassment, harm, injury, intimidation, or disturbance of others; material that may constitute or encourage criminally relevant, dangerous, or self-harm-inciting activities; material containing threats of any kind
use the Service in a way that creates, even potentially, a conflict of interest or in a way that compromises the purposes of the Service itself
communicate any private information attributable to third parties, including addresses, telephone numbers, email addresses, identity document details, or credit card numbers without the consent of said third parties
perform actions that violate the rights of others, including intellectual property rights
Any content or information shared on the Service by users may be removed if deemed by BESTIE BITE srl to be in violation of these Terms and Conditions, applicable regulations, intellectual property rights, or in cases provided for by law. BESTIE BITE srl reserves, in such cases, the right to refuse or discontinue the provision, even partially, of the Service. Should any dispute arise from third parties regarding any content or related conduct that infringes upon their rights, the user assumes full responsibility and undertakes to hold BESTIE BITE srl harmless and indemnified from any damage, loss, or expense.
that they do not carry out professionally organised self-employment activities and therefore fall within the VAT exclusion regime (art. 5 D.P.R. n. 633/1972)
that they do not hold any employment or position with public administrations and/or any other public law entity or body pursuant to art. 53 of D.Lgs. 165/2001 and subsequent amendments
that the total income referred to in art. 67, comma 1, lett. l) D.P.R. 917/1986, received in each calendar year for Occasional Self-Employment Activities and/or any other occasional self-employment activity rendered to other clients – including compensation earned through the Application and indicated in the Statistics, as well as the amount indicated and derived from rewards – does not exceed the overall limit in the calendar year of EUR 5,000.00 and that, therefore, pursuant to art. 44 of D.L. 269/2003, they are not subject to the obligation to register with the separate management referred to in art. 2, comma 26, of legge 8 agosto 1995, n. 335.
A condition for accessing and using the Service is that users respect any copyright, trademark, or other intellectual property right of any other party. Users, and in particular Creators, guarantee that their content uploaded to the Platform does not infringe, in any way even potentially, any copyright, industrial property right, or other third-party right. In case of violation of such rights, the user assumes full responsibility and undertakes to hold BESTIE BITE srl harmless. When a user shares or publishes content covered by intellectual property rights in relation to or in connection with the Service, they grant BESTIE BITE srl a non-exclusive, transferable, sublicensable licence for the use, transmission, distribution, modification, performance, copying, display, translation, and creation of derivative works of their content. If users use, with prior written authorisation, content covered by intellectual property rights owned by BESTIE BITE srl, the latter reserves all rights relating to such content. BESTIE BITE srl, in any case, reserves the right to block, at any time and without notice, the accounts of users who are deemed or presumed to be in violation of copyright or intellectual property rights. For the specific regulation of relationships and rights in the field of intellectual property, reference is also made to the contractual clauses previously agreed upon between Creators and BESTIE BITE srl.
In the case of publication of videos or other content including musical elements, users are solely responsible for such content as nothing constitutes authorisation by BESTIE BITE srl for the use of music for which the respective licences have not been obtained. Users who share such content through the Service declare that they hold all authorisations, licences, and permissions from the rights holders. The right of use of content granted to BESTIE BITE srl excludes any obligation to pay royalties to third parties. Third parties include, for example, owners of recording copyrights (such as a record label), of a musical work (for example, a music publisher), a copyright protection organisation (for example, SIAE in Italy), or any other copyright participant involved in the creation of the content.
Bestie Bite srl uses advanced technologies, including artificial intelligence models, for the following purposes: — Video labelling: AI models analyse video content uploaded to the Platform to generate automatic labels and categorisations, improving content search and discovery. — AI Concierge (intelligent search): a search system based on large language models (LLMs) enables users to find restaurants through natural language queries. The system uses the user's dietary preferences, GPS location and language to personalise results and generates natural language explanations for the recommendations provided. Conversations can be multi-turn, allowing the user to refine their search. — Content personalisation: AI technologies contribute to personalising the user experience on the Platform, adapting the content shown based on the user's preferences and behaviour. BESTIE BITE srl reserves the right to use AI technologies in the future also for content moderation and for additional purposes functional to improving the Service.
BESTIE BITE srl offers users its Platform and related functions without any obligation to provide specific services. The Service is made available through the website, app, and applications which may contain banners or links to other Internet sites or applications that are not managed or controlled by BESTIE BITE srl; the availability of such banners or links does not imply approval or endorsement by BESTIE BITE srl of the content of the related sites, nor does it imply any form of guarantee or liability on the part of the latter, including in relation to any losses or damages that may be caused by the use of third-party websites. BESTIE BITE srl makes no representation or warranty, express or implied, regarding the accuracy, completeness, or timeliness of any content published by users or on other third-party sites and services; links to these are provided for informational purposes only. The user acknowledges that BESTIE BITE srl has no obligation to pre-screen, monitor, review, or modify any content published by users or third parties on the Platform. Users acknowledge and accept that when they view content provided by third parties through the Service, they do so at their own risk. With regard to information provided by third parties through the Service, users must personally verify individual details or links, as BESTIE BITE srl makes no representation or warranty in this regard and is not responsible for the content of offers or any contracts entered into with third-party providers. BESTIE BITE srl reserves the right to make changes to the content or functionality, to suspend or discontinue, in whole or in part, the Service at any time and without notice, and without being required to state the reasons for such actions. In particular, for technical issues (such as, for example, server and other electronic device malfunctions, software malfunctions, computer viruses, as well as actions by hackers or other users with access to the network) BESTIE BITE srl shall not be held liable under any circumstances.
Unless otherwise provided by mandatory legal provisions, the relationship between BESTIE BITE srl and users is governed by Italian law and jurisdiction, on the basis of which these Terms and Conditions of the Service shall also be interpreted, and the Court of Rome shall have exclusive jurisdiction to settle any dispute regarding these Terms and Conditions and the relationships governed by them.
BESTIE BITE srl reserves the right to modify these Terms and Conditions at any time. In the event of substantial changes, BESTIE BITE srl will notify users by publishing a relevant notice on its Platform or through other means of communication. These Terms and Conditions may be subject to periodic changes, for example in the event of updates to the Service features, or the combination with applications or services managed by BESTIE BITE srl or by third-party partners, or in the event of regulatory changes. Users are advised to periodically review the Terms and Conditions for any changes.
Users who wish to delete their account and associated data can do so by following these simple steps:
Access your profile through the Bestie Bite app
Navigate to the "Settings" section
Select the "Deactivate Profile" option
Once the user has deactivated their profile, the following process will be initiated:
All personal data of the user will be deleted from Bestie Bite's servers within a period of 30 days from the request
Content published by the user on the platform will be removed, with the exception of videos for which compensation has been recognised (monetary or in points), which will remain visible on the associated restaurant page pursuant to section 4.2
Aggregated or anonymised data that cannot be directly associated with the user may be retained for statistical or analytical purposes, but will no longer be associated with the deleted user's account
Please note that once the account is deleted, it will not be possible to recover the data associated with it.
